Employees who fall sick whilst they are taking annual leave now have the right to re take that leave at a later date, irrespective of when they fall ill. This is included in a ruling made by the European Court of Justice in June 2012. Previously the Court had held that a worker who is unfit prior to the start of their annual leave was entitled to take that leave at another time, but now the point at which the illness commenced is irrelevant.
